Register of Clause 4.6 variations

Council is required to keep a register of Clause 4.6 variations to a development standard, which is located below. Variations are only supported in particular circumstances where strict compliance would be unreasonable or unnecessary and there are sufficient environmental planning grounds to justify contravening the development standard.

An application proposing a variation to a standard, must be supported by a written submission demonstrating how the development meets the provisions of Clause 4.6 of the relevant Environmental Planning Instrument.

The Register is referred to the NSW Department of Planning, Industry and Environment on a quarterly basis.
