State Significant Development and Transport Oriented Development DAs

In May 2024, the Government implemented the Transport Oriented Development (TOD) planning policy for areas within 400m of Roseville, Lindfield, Killara and Gordon stations.

On 5 June 2025, Council adopted an alternate preferred scenario which has been submitted to Department of Planning, Housing and Infrastructure (DPHI).

Latest update: 13 June 2025

On 13 June 2025 DPHI turned off the TOD for new development applications.  

  • This means that for the time being, new local development applications and state significant development applications can no longer be lodged under the TOD controls. 
  • Nor can applications be lodged under Council’s alternate planning controls until such time as they are implemented by DPHI.
  • However, applications can still be lodged under Council’s existing planning controls, KLEP 2015.
  • The local development applications and state significant development applications that were lodged prior to turning off the TOD on 13 June have been ‘saved’ and the TOD controls will still apply to these applications.
  • On 19 June, DPHI published updated maps under the Ku-ring-gai Local Environmental Plan (Housing) (Map)(PDF, 704KB). These maps identify the locations where local development applications and state significant development applications have been ‘saved’ and the TOD controls still apply.

State Significant Development Applications in TOD

What are State Significant Development (SSD) applications? And what is Council’s role?

SSD applications are for large scale or complex projects deemed important to the state for economic, environmental or social reasons. SSD applications are assessed by the Department of Planning, Housing and Infrastructure and determined by the Minister for Planning or Independent Planning Commission. Council is notified of and invited to comment on SSD applications at the exhibition stage. Developments for in-fill affordable housing with a capital investment value (CIV) of more than $75 million qualify for an SSD application.

What is a secretary’s environmental assessment requirements (SEARs)?

SEARs identify what information needs to be included in the environmental impact statement (EIS). A request for SEARs must be made for all SSD projects before a development application can be submitted.

TOD DAs with a value of $30,000,000 to $75,000,000 are generally determined by the Sydney North Planning Panel (SNPP).

EOI through the Housing Delivery Authority in TOD

To accelerate the delivery of homes, the NSW Government has established the Housing Delivery Authority (HDA) — a panel that considers whether major residential projects should be treated as State Significant Developments (SSDs).

The HDA provides a fast-track pathway into the SSD system, even for projects that don’t meet all the standard SSD criteria. However, the HDA does not approve development applications. Its role is to recommend whether a project should be declared SSD. A project only becomes an SSD if the Minister for Planning agrees and makes a formal declaration.

To be eligible for the HDA pathway, projects must generally have an Estimated Development Cost (EDC) of $60 million or more in Greater Sydney, or $30 million or more in regional NSW.

Unlike the standard SSD process, the HDA can also support concurrent rezonings, enabling projects to progress more quickly without requiring a separate, and often lengthy, rezoning process.

What is Council’s role?

Council does not decide on proposals considered by the Housing Delivery Authority (HDA). If the Minister declares a project as a State Significant Development (SSD), it enters the same assessment process as other SSDs. This means Council is notified and invited to comment during the public exhibition stage and may also be consulted on any related rezoning matters. While Council’s input is considered as part of the assessment, the final decision is made by the Minister for Planning or the Independent Planning Commission, not Council.
